Fumigation license canceled
President Petro Poroshenko has signed the Law “On Licensing of Economic Activities”.
Law No. 222-VIII of March 2, 2015 regulates public relations in the field of licensing of economic activities, defines an exclusive list of economic activities subject to licensing, establishes a unified procedure for their licensing, supervision and control in the field of licensing, and liability for violation of legislation in this area.
The law significantly simplifies the procedure for obtaining licenses, reduces the number of types of economic activities (including fumigation activities) subject to licensing, which will allow Ukraine to improve its rating in the World Bank’s classification by creating more favorable conditions for the development of entrepreneurship and increasing Ukraine’s investment attractiveness.
Commenting on the Law, Dmytro Shymkiv, Deputy Head of the Presidential Administration, Secretary of the National Reforms Council, said: “The adoption of this Law is very important for business and for the economy of Ukraine as a whole. The law will significantly limit the opportunities for corruption in the field of licensing, will help to improve Ukraine’s position in international rankings, and will stimulate the development of entrepreneurship and investment in the economy.”

The management of SPECSPECTR believes that the abolition of the fumigation license by Law No. 222-VIII increases the risk of deaths and poisonings during fumigation and reduces the level of professionalism of fumigation companies, as now their professional level is not confirmed by anything at all.
“We insisted that the new version of the Law “On Licensing of Economic Activities” not only retain fumigation licensing, but also revise, finalize, and bring the License Terms for Fumigation Activities into compliance. We consider this situation to be a political decision designed to reduce the list of licensable activities without any desire to understand the feasibility of doing so, and with a simple goal of fulfilling the “plan to simplify business.” Moreover, the situation around the fumigation license is paradoxical – market participants, given the danger of the fumigation procedure and the need for special training, ask to “regulate them” themselves, but instead receive a refusal from the state in the form of deregulation of an already uncontrolled industry,” said Anna Holosova, CEO of SPECSPECTR Int.
